Policy on Privacy, Data, Cookies, and Marketing Communications

Please read the following carefully to understand WarChest’s views and practices regarding your personal data and how we will treat it.

WarChest Limited (“WarChest”) is committed to protecting your privacy.

This privacy and data policy (the “Privacy Policy”) tells you about how WarChest collects, manages, uses and stores information about you which you provide in connection with any WarChest game, product or service (“Products”) (including this web site). Please note that this Privacy Policy should be read in connection with the privacy policy of any applicable third party service provider (“TSP”), such as Apple, Facebook or Flurry.

Please read this Privacy Policy carefully as it sets out the basis on which any personal data WarChest collects from you, or that you provide to WarChest, will be processed by us.

By installing, accessing, registering to or otherwise using the Products, you agree to this Privacy Policy and give explicit and informed consent to the processing of your personal data in accordance with this Privacy Policy. If you do not agree with this Privacy Policy, please do not install, access, register to or otherwise use the Products.

If we ask you to provide certain information by which you can be identified when using this website or our Games, then you can be assured that it will only be used in accordance with this privacy statement.

WarChest may change this policy from time to time by updating this page. You should check this page from time to time to ensure that you are happy with any changes.

Products are intended for use by those 13 or older for amusement purposes only. In any event WarChest does not knowingly collect personal information from people under the age of 13. If WarChest learns that a person under the age of 13 has provided it with personal information, WarChest will take steps to delete such information as soon as possible.

When you access Products through a TSP depending on your specific privacy settings with that TSP WarChest may be able to access certain information from your account or the information given by you to that TSP. You are advised to review your privacy settings with any TSP.

By accessing the Products through a TSP you authorise WarChest to collect, store, access and use that information which you have agreed the TSP may provide to WarChest. We may use this information to create a profile for you in the Products. The information provided by the TSP may include your name, your TSP account ID number, your login email, your gender, age and location, your birthday, details of your contacts on the TSP.

In addition during your use of the Products you agree that the following terms will apply:

  • WarChest may ask you for certain information and you may submit personal data to the Products (such as your name, email address and contact details) when you sign up to the Products.
  • You agree and acknowledge that all data submitted by you in connection with your use of the Products will be subject to any additional privacy policy terms of any TSP including those at http://www.facebook.com/about/privacy/ and http://www.flurry.com/about-us/legal/privacy.html.
  • WarChest may also record which parts of the Products you use and as user patterns. This information will be kept securely in accordance with an internal security policy and may be used:
    • to generally run, operate and maintain the Products.
    • for internal record keeping;
    • to improve our products and services;
    • to notify and inform users of updates, new products and / or promotional offers;
    • enable and process your use of and generally run our products and services.
    • to collect game scores, achievements, and in-app purchases (for example, new characters, weapons, and maps) created in the Products.

By subscribing to or using the Products and submitting your data you agree to this use.

  • WarChest may also record which parts of the Products users use and user patterns. This information will be kept securely in accordance with an internal security policy.
  • If you believe WarChest has information about you that you do not want WarChest to have or that is incorrect please contact WarChest as described above and WarChest shall correct or remove the data as you request as soon reasonably practicable.
  • If you have any other concerns over privacy, this Privacy Policy or WarChest’s Products please contact WarChest as described below.
  • The Products may also use software which records whether you have used the Products before on your computer and other information about your use. This is used to improve the Products and the services available to you. For example you may be asked if you wish the Products to remember your computer, your UDID and/or your username and password. You may disable this function by changing your login and account settings.

Use of Cookies, Beacons and Tracking by WarChest

Cookies are small text files that are placed on your computer by websites that you visit. They are widely used in order to make websites work, or work more efficiently, as well as to provide information to the owners of the site.

One of the cookies WarChest uses is essential for parts of the Products to operate and has already been set. You may delete and block all cookies from WarChest’s site, but parts of the Products may not work.

WarChest may use other technologies such as pixel tags, clear GIFs and web beacons in any WarChest Game.

Please note:
You use the Products at entirely your own risk. It is a known risk of internet usage that people are not necessarily who they say they are. People may provide information or behave in a way that is unreliable, misleading, unlawful or illegal. WarChest has no way of telling if statements made by other users are true. This is a decision that can only be made at your discretion and the exercise of some degree of caution is recommended. By using the Products and its services you accept that this is the case and accept the risk associated with it. Users must take particular care in relation to the disclosure of their own personal information.

Third Party Communications

Where you have consented either via any TSP or directly with WarChest, WarChest may share the information you have provided with partners of WarChest and its affiliates. WarChest may also share this information with other carefully selected companies or organisations in order that they may inform you of their products and services.
In certain circumstances we may share your information with WarChest’s partner companies and service who act on our behalf with activities such as, but not limited to, fulfilling orders, processing payments, carrying out, promotional services and data management.

WarChest will only provide these companies with the information which they need to carry out their services and they will not be allowed to use the information for other purposes. They will only be allowed to use your information in the way in which we instruct them and as permitted by the UK's Data Protection Act 1998.

You also acknowledge and agree that in certain circumstances we may be obliged to disclose personal information relating to you to third parties, for example, in order to conform to any requirements of law, comply with any legal process, to prevent and detect fraud and to protect and defend the WarChest’s rights and property.

You may opt out of marketing communications by clicking the “unsubscribe” link on any marketing email or amending your settings.

Sending your data overseas

It may be necessary for WarChest to transfer your information to countries outside the European Union which do not provide the same level of protection as the UK. If we for any reason need to do so, WarChest will make sure that the information is transferred in accordance with this Privacy Statement and the UK's Data Protection Act 1998 and other applicable data protection laws so that your personal data is kept secure.

Third Party Products and Services

The Products may contain links to other sites or services of interest. However, once you have used these links to leave our Products, you should note that we do not have any control over those third party sites or services. Therefore, we cannot be responsible for the protection and privacy of any information which you provide whilst visiting such sites and such sites are not governed by this privacy statement. You should exercise caution and look at the privacy statement applicable to the website in question. Such sites and services have not been verified or reviewed by WarChest and WarChest has no liability for any use and access of them.


Some of WarChest’s Products may use services provided by Flurry. Those services may include the use of a tracking pixel, agent or any other visitor identification technology that collects, uses, shares and stores data about end users of the Products. WarChest’s Products may use online software services provided by Fireteam. Those services may include but not limited to matchmaking, transmedia connectivity, friends-features and player stats. More information about this can be found here: http://fireteam.net/products

Ad Serving Technology

WarChest may employ third party ad serving technologies (for example Flurry, AdMob, iAd, AdColony) that use precise methods to collect information as a result of ad serving through Products. Third parties may collect and use data for this purpose including software, applications, hardware, browser information, internet and on-line usage information and in-game information. The aforementioned data may be used and disclosed in accordance with this Privacy Policy and the privacy policy of the company providing the ad serving technologies. You recognize and accept that the advertising companies who deliver ads for WarChest may combine the information collected with other information they have independently collected from other services or products. These companies collect and use information under their own privacy policies. Although WarChest takes commercially reasonable steps to instruct such advertising companies to comply with the terms and conditions of this Privacy Policy, WarChest does not have access to or control of third party technologies.
